1About these terms

These terms apply when you use worthitdrivingschool.com.au or book lessons with Worth It Driving School. In these terms, “we”, “us” and “our” means Worth It Driving School, operated by Darren Worthington as a sole trader (ABN 38 279 508 839), and “you” means the person using the website or booking a lesson, and the learner if that is someone else. By using the website or making a booking, you agree to these terms.

2About us

Darren Worthington is a driving instructor licensed by Transport for NSW (licence number 13791). We provide lessons in Dapto and the surrounding Illawarra.

3Making a booking

  • Bookings can be made through our website or by contacting us directly. A booking is confirmed once you receive a confirmation from us.
  • Please make sure the details you give us are accurate, including the learner’s name, mobile number and pickup address.
  • If you are booking for someone else, such as your son or daughter or a client of your organisation, please make sure you have their agreement to share their details with us.
  • For learners under 18, bookings are made by a parent or guardian, or with their permission.

4Before each lesson

To keep everyone safe and to meet NSW road rules, we ask that each learner:

  • holds a current NSW learner or driver licence and brings it to every lesson;
  • is fit to drive, which means a zero blood alcohol reading and no drugs or medication that affect driving (learner and provisional drivers in NSW must have a zero alcohol reading);
  • wears suitable, enclosed footwear and brings their glasses or contact lenses if their licence requires them; and
  • lets us know about anything that may affect their driving, so we can plan the lesson around it.

If a learner arrives without a licence or is not fit to drive, the lesson may not be able to go ahead and will be treated as a late cancellation.

5On the day

Please be ready at the pickup point at the booked time. If a learner is running late, the lesson may still need to finish at the scheduled time so the next learner is not affected, and the full lesson fee applies.

6Prices and payment

  • Prices are shown on our website and are in Australian dollars. Darren is not registered for GST, so no GST is charged on our prices.
  • Online payments can be made by card, Afterpay or Klarna, and are processed securely by our payment providers. If you pay using a buy now, pay later service, that provider’s own terms also apply.
  • When you pay, please make sure you are authorised to use the payment method you choose.
  • We may update our prices from time to time. Lessons and packages already paid for are not affected.

7Lesson packages

Packages are paid for up front and added to the learner’s account as lesson credits. Each lesson booked uses one credit, and a cancellation made with enough notice (see section 8) returns the credit.

  • Packages are valid for 12 months from the date of purchase.
  • Credits belong to the learner the package was bought for, and can be transferred to another learner by arrangement with us.
  • Packages are not refundable for credits that are not used within that time, other than where the Australian Consumer Law requires a refund (see section 10). If something changes and you are not able to finish a package, please talk to us and we will do our best to help.
  • If a parent, guardian or organisation buys a package for a learner, the receipt goes to the person who paid, and the booking link goes to the learner or the person who paid so a time can be chosen.

8Cancelling or rescheduling

  • Life happens, and we are glad to move a lesson when we can. Please give us at least 24 hours notice to cancel or reschedule.
  • Cancellations with less than 24 hours notice, or not being there at the pickup time, may mean the lesson is charged or the credit is used. We understand genuine emergencies, so please let us know.
  • If we need to cancel, for example because of illness, vehicle trouble or unsafe weather, we will offer another time at no cost, or a refund for that lesson if you prefer.
  • For everyone’s safety, we may end a lesson early if continuing would be unsafe. Where that happens for reasons outside the learner’s control, we will make it up to you.

9Driving test packages

Learners book their own driving test with Service NSW, and then book the test package with us for that date and time. The test package includes:

  • a one hour lesson immediately before the test;
  • use of our dual control car for the test; and
  • a lift to the test centre, and home again afterwards.

Please let us know as soon as the test is booked so we can hold the time. If Service NSW cancels or moves the test, or the learner is unable to sit it on the day, we will work with you to find the fairest option.

10Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. If something has not gone the way it should, please talk to us first and we will do our best to work it out with you.

11Safety and conduct

Our lessons are built on patience and respect. We ask learners to follow the instructor’s directions during a lesson, and we will always treat our learners with courtesy and respect in return.

To report misconduct by a driving instructor, call Transport for NSW on 131 500.

12Using our website

  • We work hard to keep our website accurate and up to date, but availability, prices and information may change without notice.
  • The content on our website, including text, photos and logos, belongs to us or is used with permission. Please ask before copying or reusing it.
  • Our website may link to other websites, such as Google reviews or Service NSW. Those sites have their own terms, and we are not responsible for their content.
  • Please do not use our website in any way that is unlawful or that could damage it or interfere with other people using it.

13Liability

To the extent permitted by law, and apart from the consumer guarantees mentioned in section 10, we are not liable for any indirect loss arising from the use of our website. We hold the insurance required of NSW driving instructors.

14Privacy

How we look after your personal information is explained in our Privacy Policy, available at worthitdrivingschool.com.au.

15General

  • These terms are governed by the laws of New South Wales, Australia.
  • We may update these terms from time to time. The version on our website at the time of your booking applies to that booking, and changes will never remove rights you have under the law.
  • If any part of these terms turns out not to be enforceable, the rest still applies.
